次のとおり一般競争入札に付します。

1調達内容

6. (6)入札方法
  落札者の決定は最低価格落札方式により行うものである。
  [1]入札者は、調達件名の本体価格のほか、業務の履行に要する一切の諸経費を含めた契約金額を見積もるものとする。
  [2]落札決定に当たっては、入札書に記載された金額に当該金額の10パーセントに相当する額を加算した金額（当該金額に1円未満の端数があるときは、その端数金額を切り捨てるものとする。）をもって落札価格とするので、入札者は消費税に係る課税事業者であるか免税事業者であるかを問わず、見積もった契約金額の110分の100に相当する金額を記載した入札書を提出しなければならない。
7. (7)電子調達システムの利用
  本案件は、電子調達システムで行う。
  なお、電子調達システムによりがたい者は、書面により申し出た場合に限り、紙入札方式に代えることができる。
  紙入札方式の場合については、郵送にて厚生働省競争参加資格（全省庁統一資格）及び入札書の提出を行う。
2競争参加資格
1. (1)令和04・05・06年度厚生労働省競争参加資格（全省庁統一資格）において、「役務の提供等」のうち営業品目が「情報処理」又は「ソフトウェア開発」で「Ａ」又は「Ｂ」の等級に格付けされている者であること。
2. (2)予算決算及び会計令第70条の規定に該当しない者であること。なお、未成年者、被保佐人又は被補助人であって契約締結のために必要な同意を得ている者は、競争入札に参加することができる。
3. (3)予算決算及び会計令第71条の規定に該当しない者であること。
4. (4)資格審査申請書又は添付書類に虚偽の事実を記載していないと認められる者であること。
5. (5)経営の状況又は信用度が極度に悪化していないと認められる者であること。
6. (6)次の各号に掲げる制度が適用される者にあっては、この入札の入札書提出期限の直近２年間（オ及びカについては２保険年度）の保険料について滞納がないこと。
  ア　厚生年金保険、イ　健康保険（全国健康保険協会が管掌するもの）、ウ　船員保険、エ　国民年金、オ　労働者災害補償保険、カ　雇用保険
7. (7)厚生労働省から指名停止を受けている期間でないこと。
8. (8)過去１年以内に厚生労働省所管法令違反により行政処分を受けていないこと。
  ただし、労働基準関係法令違反（※）により労働基準監督機関から使用停止等命令を受けたが、是正措置を行い「使用停止等命令解除通知書」を受理している場合には、この限りではない。
  ※　労働基準法、労働安全衛生法、最低賃金法、賃金の支払の確保等に関する法律、家内労働法、作業環境測定法、じん肺法、炭鉱災害による一酸化炭素中毒症に関する特別措置法
9. (9)過去１年以内に厚生労働省所管法令違反により送検され、この事実を公表されていないこと。
10. (10)その他予算決算及び会計令第73条の規定に基づき、支出負担行為担当官が定める資格を有する者であること。
11. (11)当該業務を確実に実施できると認められる要員及び設備等を有している者であること。
12. (12)品質管理体制について「ISO9001： 2015」、組織としての能力成熟度について「CMMI レベル3 以上」のうち、いずれかの認証を受けていること。
13. (13)「プライバシーマーク付与認定」、「ISO/IEC27001 認証（国際基準）」及び「JIS Q 27001認証（日本工業規格）」のうち、いずれかの認証を受けている者であること。なお、「ISO/IEC27001 認証（国際基準）」、「JIS Q 27001 認証（日本工業規格）」については、本業務を実施する組織において認証を取得していること。
14. (14)過去１年以内に厚生労働省所管法令違反により行政処分を受けていないこと。ただし、次の各号に掲げる労働基準関係法令の違反により労働基準監督機関から使用停止等命令を受けたが、是正措置を行い「使用停止等命令解除通知書」を受理している場合には、この限りではない。

15. (15)過去1 年以内に厚生労働省所管法令に基づく公表制度により、又は違法な長時間労働や過労死等が複数の事業場で認められた企業として、平成29 年1 月20 日付け基発0120 第１号厚生労働省労働基準局長通達「違法な長時間労働や過労死等が複数の事業場で認められた企業の経営トップに対する都道府県労働局長等による指導の実施及び企業名の公表について」記3、平成31 年1 月25 日付け基発0125 第1 号「裁量労働制の不適正な運用が複数の事業場で認められた企業の経営トップに対する都道府県労働局長による指導の実施及び企業名の公表について」記の3 に基づく企業名の公表をされていないこと。

  入札に参加を希望する者は、支出負担行為担当官が指定する暴力団等に該当しない旨を記した誓約書を提出しなければならない。
  入札者は、支出負担行為担当官から当該書類に関し説明を求められた場合は、これに応じなければならない。
4. (4)留意事項
  ア　入札者から提出される契約関係書類については、事業者としての決定であることを要する。
  イ　契約関係書類に虚偽記載等の不正が発覚した場合は、契約解除は違約金を徴収することがある。
5. (5)入札の無効
  上記２に示した競争参加資格を有しない者のした入札及び入札に関する条項に違反した入札は無効とする。
  また、（３）の誓約書を提出せず又は虚偽の誓約をし、若しくは誓約書に反することとなったときは、当該者の入札を無効とする。

  本公告に示した業務を履行できると支出負担行為担当官が判断した入札者であって、予算決算及び会計令第79条の規定に基づいて作成された予算価格の制限の範囲内で最低価格をもって有効な入札を行った者を落札者とする。

5Summary

6. (6)Qualifications for participating in the tendering procedures :
  Supplier eligible for participating in the proposed tender are those who shall :
  [1] Have Grade “A” or “B” in the public tender qualification category of “Information processing” or “Software development” among “Offer of services,etc” by the Ministry of Health, Labour and Welfare (The common qualification for all ministries and agencies) in the fiscal years of 2022, 2023 and 2024.
  [2] Not come under Article 70 of the Cabinet Order concerning the Budget, Auditing and Accounting.
  Furthermore, minors, Person under Conservatorship or Person under Assistance that obtained the consent necessary for concluding a contract may be applicable under cases of special reasons within the said clause
  [3] Not come under Article 71 of the Cabinet Order concerning the Budget, Auditing and Accounting
  [4] Prove to have no false statement in tendering documents.
  [5] Prove neither the business condition nor credibility is deteriorating.
  [6] For bidders subject to the following insurance system of each item , and it is not in arrears either of insurance premiums (2 insurance year about (5) and (6)) for the last two years of the bid submission deadline of this bid：(1)　Welfare annuity insurance(2)　Health insurance (the thing which association of national health insurance has jurisdiction over)(3)　Seamen's insurance(4)　National pension(5)　Worker's compensation insurance(6)　Unemployment insurance
  [7] Not be a period receiving a nomination stop from Ministry of Health, Labour and Welfare.
  [8] Not be received any administrative sanctions for violation of the Laws and Regulations under the jurisdiction Ministry of Labour, Health and Welfare within 1 year. However, this shall not apply in the case where the supplier took corrective actions and received “Notification of withdrawing for the order of suspension of use” after received an order of suspension of use by Labour Standard Inspection Administration, due to violation of the Labour Standard related laws and regulations(*).
  (*) Labour Standards Law, Industrial Safety and Health Act, Minimum Wage Act, Act on Securing the Payment of Wages, Industrial Homework Act, Working Environment Measurement Act, Pneumoconiosis Act, Act on Special Measures concerning Carbon Monoxide Poisoning Caused by Coal-Mine Accident.
  [9] Not be sent the documents to the public prosecutor’s office due to violation of the Laws and Regulations under the jurisdiction Ministry of Labour, Health and Welfare and be made this fact public.
  [10] Meet the qualification requirements which The Obligating Officer Director may specify in accordance with Article 73 of the Cabinet Order.
  [11] The person must have the personnel, equipment, etc. that are recognized to be able to reliably carry out the relevant work.
  [12] The quality management system must be certified to ISO 9001: 2015, and the organization's ability maturity must be certified to CMMI level 3 or higher.
  [13] The person must have received one of the following certifications: "Privacy Mark Certification", "ISO/IEC27001 Certification (International Standard)", and "JIS Q 27001 Certification (Japanese Industrial Standards)". Please note that the organization implementing this work must have obtained ISO/IEC27001 certification (international standard) and JIS Q 27001 certification (Japanese Industrial Standards).
  [14] The applicant must not have received administrative punishment for violating laws and regulations under the jurisdiction of the Ministry of Health, Labor and Welfare within the past year. However, if you have received a suspension of use, etc. order from a labor standards supervisory agency due to a violation of the labor standards-related laws listed in the following items, but have taken corrective measures and received a "Notice of Lifting of a Suspension of Use, etc. Order" , but not limited to this.
